Temporary Residence

Visitor Visa

A visitor visa (also called a temporary resident visa) is an official document that Immigration stick in your passport. It shows that you meet the requirements needed to enter Canada.
Most travellers need a visitor visa to travel to Canada. You may also need one if you are transiting through Canadian airport on your way to your final destination.
You can apply for a visitor visa online or on paper.
There are three categories of visitor visa;

  • Single entry Visa
  • Multiple Visa
  • Super Visa

Single entry visa allows the rightful holder to enter Canada only once and multiple visa is opposite to this which allows you to enter Canada multiple times within a valid period of time. Visitors can stay for up to 6 months in Canada. At the port of entry, the border services officer may allow you to stay for less or more than 6 months. If so, they’ll put the date you need to leave by in your passport.

Requirements to apply visitor visa;

  • Have valid travel document
  • No criminal record
  • The person should be financially sound and show sufficient proofs of employment prospects.
  • Have strong ties to country of residence
  • Convince immigration officer that you will leave Canada at the end of your stay.

How Long you can Stay

Most visitors can stay for up to 6 months in Canada.

At the port of entry, the border services officer may allow you to stay for less or more than 6 months. If so, they’ll put the date you need to leave by in your passport. They might also give you a document, called Visitor extension/visitor record which will show the date you need to leave by.

Eligibility

You must meet some basic requirements to get a visitor visa. You must:

  • have a valid travel document like a passport
  • be in good health
  • have no criminal or immigration-related convictions
  • convince an immigration officer that you have ties—such as a job, home, financial assets or family—that will take you back to your home country
  • convince an immigration officer that you will leave Canada at the end of your visit
  • have enough money for your stay
    • The amount of money you will need depends on how long you will stay and if you will stay in a hotel, or with friends or relatives.

Some people are not allowed to enter Canada

Some people are not admissible to Canada, which means they are not allowed to enter the country. You can be inadmissible for several reasons, including being involved in:

  • criminal activity
  • human rights violations
  • organized crime

Minor children travelling to Canada

Make sure you know what to do if your minor children (children under the age of 18) will be travelling with you, with someone else, or alone



Super Visa

A super visa lets you visit your children or grandchildren for up to 2 years at a time. It’s a multi-entry visa that provides multiple entries for a period up to 10 years.

If you want to stay for 6 months or less, apply for a Visitor Visa


Eligibility

To be eligible for a super visa, you must:

  • be the parent or grandparent of a Canadian citizen or a permanent resident of Canada
  • have a signed Sponsorship letter from your children/grandchildren that includes:
    • a promise of financial support for the length of your visit
    • the list and number of people in the household of this person
    • a copy of this person’s Canadian citizenship or permanent resident document
  • have medical insurance from a Canadian insurance company that is:
    • valid for at least 1 year from the date of entry
    • at least $100,000 coverage
    • have proof that the medical insurance has been paid (quotes aren’t accepted)

Financial support 

The child or grandchild who invites you must prove that their household meets the minimum necessary income. The following documents are examples of what can be used as proof of funds:

  • Notice of Assessment (NOA) or T4/T1 for the most recent tax year
  • Employment Insurance stubs
  • employment letter including salary and date of hiring
  • pay stubs
  • bank statements

Other conditions we consider

We consider several things before we decide if you can come to Canada. You must be a genuine visitor to Canada who will leave by choice at the end of your visit.

We’ll look at these things when you apply:

  • your ties to your home country
  • the purpose of your visit
  • your family and finances
  • the overall economic and political stability of your home country



Study Permit

Overview  

The study permit is a document that Immigration issue Which allows foreign nationals to study at designated learning institutions (DLI) in Canada. Most foreign nationals need a study permit to study in Canada


Eligibility Requirements

Applicants are allowed to apply for Study Permit if they meet below mentioned requirements:

  1. Be able to convince the visa officer that you will honor the terms of temporary resident permit (study permit) and will leave the country once the study is complete.
  2. You are required to have a letter of acceptance from a Designated learning institution in order to submit an application for a study permit
  3. Proof of financial resources to pay for tuition fees and living expenses for yourself and accompanying family members.
  4. Police clearance
  5. Not be a risk to the security of Canada
  6. Be in good health (complete a medical examination, if required
  7. You are enrolled at a designated learning institution (DLI)
  8. Prove you have enough money to pay for your:

  • Tuition fees
  • Living expenses for yourself and any family members who come with you to Canada and
  • Return transportation for yourself and any family members who come with you to Canada

  1. Obey the law, have no criminal record and get a police certificate (if required)
  2. You are in good health and get a medical exam (if required)
  3. Prove to an officer that you will leave Canada when your study permit expires


Your Responsibilities

While Studying in Canada you must:

  1. Have a valid study permit.
  2. You are a full-time student at a designated learning institution (DLI).
  3. You have started studying.
  4. You are in a program that leads to a degree, diploma or certificate and is at least six months long and
  5. You have a Social Insurance Number (SIN).
  6. Make progress towards completing your program
  7. Respect any conditions listed on your study permit
  8. Stop studying if you no longer meet the requirements and leave Canada when your permit expires
  9. Depending on your case, there may be conditions on your study permit such as:
    • If you’re allowed to work in Canada
    • If you’re allowed to travel within Canada
    • The date you must stop studying

Important Note

If You have lost your student status if you’re still in Canada and the expiry date of your permit passed before you applied for a new Study permit or Work permit in some cases, you may apply to restore your status as a student. To apply, you must

  • submit your application within 90 days of losing your status
  • keep meeting the requirements for your stay
  • have met all the conditions listed on your permit, and
  • pay your fees
  • restoration fee
  • study permit

When to apply

You should apply to extend your permit at least 30 days before it expires. Make sure your passport doesn’t expire at the same time. You can’t extend your study permit beyond your passport’s expiry date.

How to apply

Before you apply to extend your study permit, make sure your school is on the designated learning institution list (DLI). If your school is no longer on the DLI list, you can keep studying until your current permit expires. When you need to extend your study permit, you’ll need to enroll at a DLI. You may either Apply it Online or can do a paper Application.

 


Work Permit

Most foreign nationals need a work permit to work in Canada.

There are 2 types of work permits.

  • Employer-specific work permit (closed work permit)
  • Open work permit


Closed Work Permit: LMIA based Work Permit

An employer-specific work permit allows you to work according to the conditions on your work permit, which include:

  • The name of the employer you can work for
  • How long you can work
  • The location where you can work (if applicable)
  • An LMIA is a document from Employment and Social Development Canada/Service Canada that allows an employer to hire a foreign worker through the Temporary Foreign Worker Program (TFWP).

Before you submit your work permit application, your employer must give you:

  • A copy of the positive LMIA, and
  • Your job offer letter or contract.


Open Work Permit

An open work permit can be issued to a foreign national only under one of the Labour Market Impact Assessment (LMIA) exemptions.

A foreign national may apply for an open work permit outside Canada, at a port of entry or after arrival to Canada, as per program requirements.

Types of open Work Permits

There are two types of open work permits:

  • Unrestricted (allowing foreign nationals to work in any occupation and location)
  • Restricted (restricting the occupation or the location)

Open work permits may be issued with the following:

  • Pccupational restrictions, depending on the applicant’s medical status [R185(b)]
  • Location restrictions, depending on the category (such as a bridging open work permit under the provincial nominee class)

You may be eligible for an open work permit if you:

  • Are an international student who graduated from a designated learning institution and are eligible for the Post-Graduation Work Permit Program
  • Are a student who’s no longer able to meet the costs of your studies (destitute student)
  • Have an employer-specific work permit and are being abused or at risk of being abused in relation to your job in Canada
  • Applied for permanent residence in Canada
  • Are a dependent family member of someone who applied for permanent residence
  • Are the spouse or common-law partner of a skilled worker or international student
  • Are the spouse or common-law partner of an applicant of the Atlantic Immigration Pilot Program
  • Are a refugee, refugee claimant, protected person or their family member
  • Are under an unenforceable removal order
  • Are a temporary resident permit holder
  • Are a young worker participating in special programs


Post Graduate Work Permit

An open work permit allows you to work for any employer in Canada, except for an employer. There are two different Categories that Candidate can Apply under Post Graduate Work permit and Spousal open Work Permit.

Post Graduate Work permit – In order to file a post graduate Work Permit, Applicant must also have

  • Completed a study program
    • At a designated learning institution
    • That was at least 8 months long and
    • That led to a degree, diploma or certificate
  • Maintained full-time status as a student in Canada during each semester of your study program
    • This doesn’t include your final semester, which can be part-time, or if you took an approved leave from your studies
  • Graduated from 1 of the following:
    • A public post-secondary school, such as a college, trade/technical school, university or CEGEP (in Quebec)
    • A private post-secondary school (in Quebec) that operates under the same rules as public schools in Quebec
    • A private secondary or post-secondary school (in Quebec) that offers qualifying programs of 900 hours or longer, that leads to a diplôme d’études professionnelles (DEP) or an attestation de spécialisation professionnelle (ASP)
    • A Canadian private school that can award degrees under provincial law (for example, Associate, Bachelor’s, Master’s or Doctorate degree), but only if you’re enrolled in a study program that leads to a degree as authorized by the province.


Extension of Work Permit

Overview of Extension of Work Permit – In order to work for longer period of Time in Canada, Work Permit Extensions can be filed. Applicants can apply this extension if

  • Want to extend your work permit
  • Need to make changes to the conditions on your work permit, such as:
    • The type of work you can do
    • The employer you can work for
    • Where you can work

Extension of Spousal open Work Permit – In order to file an extension of a Spousal open Work Permit, your spouse or common-law partner should have

  • Have a valid study permit or a work permit and
  • Are should be a full-time student or should be employed in a firm at NOC O, A or B Category job.

Employer-specific work permits –You need to apply to extend or change the conditions of your work permit if:

  • Your job is extended
  • There are changes to your current job, such as:
    • A change in your pay
    • New responsibilities
  • You’re offered a different job
  • You want to work for a new employer

You can’t start working at a different job or for a new employer until you get your work permit with the new conditions.
